This study aims to analyze the extent of protection provided by the State and International Organizations during the 1980s and 1990s, particularly in Brazil and Honduras, concerning the actions of environmental activists Chico Mendes and Luna López. It is noteworthy that the Inter-American Court of Human Rights acknowledged the need to protect the individual rights of environmental defenders (physical integrity and life), whose primary mission was to fight against environmental degradation. The research used a bibliographic review method, based on the analysis of articles, legal doctrine, news reports, and official documents. The Brazilian State was negligent in the case of Chico Mendes. As for the ruling issued by the Inter-American Court of Human Rights in the case of Luna López’s assassination, it made no reference to environmental and social rights - rights guaranteed by the American Convention on Human Rights - restricting itself solely to condemning Honduras for failing to protect the life and physical integrity of the activist. Only from 2017 onward did the Inter-American Court begin to recognize the direct justiciability of economic, social, cultural, and environmental rights under Article 26 of the American Convention, though this interpretation remains controversial.
